Happy New Year friends and cherished clients! 2022 is going to be a fantastic year!

The Manitoba Securities Commission (regulatory body for Realtors and Real Estate Brokerages) has mandated that all Realtors in Manitoba are required to complete a signed Service Agreement with their clients before they continue or begin to provide help or services relating to real estate matters.

This new Real Estate Services Act replaces the former Real Estate Brokers Act and is intended to provide more protection and transparency to consumers engaging in real estate transactions in Manitoba.

A written Service Agreement between all sellers and buyers for residential, commercial,
agricultural, and industrial real estate services and their Realtor Brokerages is required in order to outline services which include:

(a) finding real estate for the person;
(b) finding another person to engage in a trade in real estate;
(c) showing or making representations about the real estate;
(d) advising on the appropriate price for the real estate;
(e) negotiating the price or other terms of a trade in real estate;
(f) presenting offers to purchase or sell respecting a trade in real estate;
(g) receiving deposit money paid in respect of the real estate;
(h) a service that is prescribed by the regulations;

(i) advertise to assist a person in the sale of real estate or advertising of the sale of that real estate.
